The judicial power of the United States shall not be construed to extend to any suit in law or equity, commenced or prosecuted against one of the United States by citizens of another state, or by citizens or subjects of any foreign state.

Right now our President, the anointed one, is in violation of amendment XI with a lawsuit against the Arizona immigration law.

Number Two: Pictue I.D. Act to prevent fraud and multiple times to vote. Reason to veto is because Dayton is aware that Republicans have most to gain with Picture I.D.

Number three: Bill to prevent abortion of live baby. Roe v Wade allows abortion thru the second trimester or 27 weeks of gestation. Baby , not fetus, is able tu sustain independent life at 20 weeks of gestation. Looks like murder to me.

Republican view:

Terrorism poses one of the greatest threats to the U.S.
The world toward which the militant Islamists strive cannot peacefully co-exist with the Western world.  In the last decade, militant Islamists have repeatedly attacked Americans and American interests here and abroad.  Terrorists must be stopped and destroyed.
The use of intelligence-gathering and military force are the best ways to defeat terrorism around the world.
Captured terrorists should be treated as enemy combatants and tried in military courts.

Democratic view:

Global warming, not terrorism, poses the greatest threat to the U.S., according to Democrats in Congress.
Terrorism is a result of arrogant U.S. foreign policy.
Good diplomacy is the best way to deal with terrorism.  Relying on military force to defeat terrorism creates hatred that leads to more terrorism.
Captured terrorists should be handled by law enforcement and tried in civilian courts.

CEO EARNINGS UP TO 10.8 MILLION

United Health chief executive officer Stephen Hemsley had a 21% increase in annual compensation to 10.8 million this year. This was accomplished with a yes vote of 96% of shareholders voting. Those people who practice class envy do surely speak up against Mr. Hemsley.

AMENDMENT X OF THE U.S. CONSTIUTION

The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.

This amendment is to protect states from seizure of their rights by government mandates from congress or executive order.

Some examples: One. Executive order to challenge the Arizona immigration law
Two. Freedom Of Choice act to disallow states to control abortion.
Three.   Seat belt law allows officer to offer ticket for seat belt violation only when stopped for some other reason. Now mandated by Feds is.Primary enforcement which allows a police officer to stop and ticket a driver if s/he observes a violation. States are forced to follow this law or will lose millions of dollars of highway funds. STATES RIGHTS ?

CHEESEBURGER BILL

The Minnesota Senate passed the “cheeseburger bill,” which would prevent people from filing lawsuits against restaurants and food companies for obesityrelated problems. The bill, which passed along largely partisan lines, already passed the House and now heads for the governor. A similar bill , Personal Responsibility In The Consumption Of Food Act, passed by US congress in 2005 was also supported by Republicans and rejected by Democrats.

SUPPORT ISRAEL

If Israel had lost the Six-Day War -- imposed on it by its enemies -- there would be no discussion, 44 years later, about restoring the country's pre-1967 borders. Israel would simply have ceased to exist. (God knows what would have happened to its Jewish inhabitants.) So why does it make sense to create a Palestinian state with precisely those borders now? Doing so simply makes Israel (more) vulnerable to enemies who seek its destruction no less today than when it was founded in 1948.  At this time our president is demanding a reversal to this policy to result in the destruction of Israel.

BOEING TO EXPAND ?

Boeing has fired back against a decision by the National Labor Relations Board to file a complaint against it opening a new non-union facility in the right-to-work state of South Carolina.
"This claim is legally frivolous and represents a radical departure from both NLRB and Supreme Court precedent," Michael Luttig, Boeing's general counsel, said in a statement. "Boeing has every right under both federal law and its collective bargaining agreement to build additional U.S. production capacity outside of the Puget Sound region."
Boeing noted that it announced plans to build a new factory in South Carolina, a right to work state, 17 months ago, and has subsequently nearly completed construction on the plant and hired 1,000 workers. The company said it plans to begin assembly of the first plane in the facility in July.

MINNESOTA HOUSE DEFUNDS ACORN 09/17/2009

Big Government has obtained the full text of the amendment–technically  a “motion to recommit” to defund ACORN. The “Defund ACORN Act” passed the House this afternoon by an overwhelming margin of 345-75. The House vote comes just days after the Senate voted 83-7 to block ACORN from receiving federal housing grants. With these votes, 80% of the members of Congress have weighed in to block ACORN from receiving any more taxpayer dollars.

In a show of bipartisan common sense, the Senate has voted 83-7 to remove federal funds from ACORN, the community organizing group dedicated to voter fraud and embezzling public funds. ACORN is an organized crime syndicate masquerading as a community service group along with Barack Obama. The only things it should receive from Congress are subpoenas.
Kudos to Senators from both parties who bowed to common sense and approved the Johanns. Let's hope this kind of behavior is contagious and makes it over to the House.

Halting State Funding to Acorn

WHEREAS, it is the responsibility of public officials in the State of Louisiana to protect the public and ensure that taxpayer funds are being responsibly, ethically, and properly spent;
WHEREAS, ACORN maintains a national headquarters office in New Orleans and has conducted financial activities in the state;
WHEREAS, upon my request for an investigation into the organization’s activities in the State, the Louisiana Attorney General’s Office subpoenaed documents of ACORN ’s national headquarters in New Orleans;
WHEREAS, seventy (70) employees of the Association of Community Organizations for Reform Now (“ACORN”) have been convicted of crimes committed in the course of their work for the organization, to date;
WHEREAS, on September 11, 2009, the U.S. Census Bureau ended its relationship with ACORN;
WHEREAS, up to twenty (20) states are investigating charges related to voting regularities and fraud into the current and past operations of ACORN;
WHEREAS, the United States Senate and House of Representatives recently voted in a bipartisan manner to cut off federal funds to ACORN;
WHEREAS, FBI Director Robert Mueller has stated his department will look into allegations of misconduct relating to ACORN;
WHEREAS, the Internal Revenue Service is aware of the current allegations facing ACORN and is conducting a “thorough review” of their relationship with the organization; and
WHEREAS, ACORN’s actions make clear that financial involvement with ACORN is contrary to the public policy of the State of Louisiana and the best interests of its citizens, and therefore should be quickly terminated if it is found to exist;
NOW THEREFORE, I, BOBBY JINDAL, Governor of the State of Louisiana, by virtue of the authority vested by the Constitution and the laws of the State of Louisiana, do hereby order and direct as follows:
SECTION 1: All departments, commissions, boards, offices, entities, agencies, and officers of the State of Louisiana, or any political subdivision thereof, are hereby prohibited from entering into any future contracts with ACORN or its subsidiaries or affiliates.
SECTION 2: All departments, commissions, boards, offices, entities, agencies, and officers of the State of Louisiana, or any political subdivision thereof, are directed to cease all existing funding for ACORN or its subsidiaries or affiliates unless such funding is legally obligated. If a department, commission, board, office, entity, agency, or officer of the State of Louisiana, or any political subdivision thereof, determines that such funding is legally obligated, it is directed to inform the Executive Counsel to the Governor of its determination.
SECTION 3: All departments, commissions, boards, offices, entities, agencies, and officers of the State of Louisiana, or any political subdivision thereof, are hereby directed to provide to the Executive Counsel to the Governor no later than October 2, 2009, a copy of any existing contracts or other agreements between the agency and ACORN or its subsidiaries for an immediate review.
SECTION 4: All departments, commissions, boards, offices, entities, agencies, and officers of the State of Louisiana, or any political subdivision thereof, are authorized and directed to assist and cooperate in implementing the provisions of this Order.
SECTION 5: This Order is effective upon signature and shall continue in effect until amended, modified, terminated, or rescinded by the Governor, or terminated by operation of law.
IN WITNESS WHEREOF, I have set my hand officially and caused to be affixed the Great Seal of Louisiana, at the Capitol, in the City of Baton Rouge, on this 17th day of September, 2009.

Defund ACORN Act - Prohibits any federal contract, grant, cooperative agreement, or other form of agreement from being awarded to, any federal funds in any other form from being provided to, or any federal employee or contractor from promoting any organization that: (1) has been indicted for a violation under any federal or state law governing the financing of a campaign for election for public office or any law governing the administration of such an election, including a voter registration law; (2) had its state corporate charter terminated due to its failure to comply with federal or state lobbying disclosure requirements; (3) has filed a fraudulent form with any federal or state regulatory agency; or (4) employs, has under contract, or retains to act on its behalf any individual who has been indicted for a violation under federal or state law relating to an election for federal or state office. Identifies, specifically, the Association of Community Organizations for Reform Now (ACORN) and any affiliate as such an organization.
Requires the Federal Acquisition Regulation to be revised to carry out provisions of this Act relating to contracts.

A large part of the influence that ACORN had in getting people to vote for Democrats was the part Senator Barack Obama had as a community organizer, though during the campaign he denied any cooperation with ACORN. Just by coincidence his campaign office at 777 Raymond Ave was right next to ACORN at 757 Raymond. B.S?

The Fairness Doctrine was adopted in 1949 and held that broadcasters were obligated to provide opposing points of views on controversial issues of national importance. It was halted under the Reagan administration. This is another way to give our government more control over our lives by way of censorship. As it is now Nielsen ratings show that conservative talk radio has more than six times as many listeners as does liberal talk radio. Compare Rush Limbaugh with 15 million listeners weekly with Alan Colmes at 2.75 million. It is natural to expect liberal Truman to favor the Fairness Doctrine and conservative Reagan to oppose knowing Limbaugh would be stifled to Colmes credit.

BREMER ARCADE

CLASS WARFARE

Enough class warfare

In response to two letters (May 9): The writers essentially assert that there is not enough “investment” by people other than the working classes (“Start investing”) and that if one feels that they have already given enough of their income to the government in taxes, then one isn’t “patriotic” (“A patriot is …”).

I’d like ask all these writers (and anyone who agrees with their premises) who exactly they are accusing of not investing in America and being unpatriotic when, according to Jennifer Rubin’s op-ed (“Soaking the rich won’t solve debt problem,” May 8), “the percentage of U.S. households paying no federal income tax … reached 51 percent for 2009” (from the Wall Street Journal and the Joint Committee on Taxation)?

Is it the 51 percent of people who pay no taxes? Or are they asking the top 10 percent of income earners (which means incomes of more than $114,000 per year, and which includes a majority of small businesses that provide most of the jobs in America) — who already pay more than 69 percent of all the taxes paid to the federal government — to give up more of their hard-earned incomes to the 51 percent who are looting the system by demanding government services but paying nothing for those services?

Who, may I ask, is being un-patriotic and not investing in America? The people who actually pay the taxes or the ones who make up more than half of our population?

Greed and envy are ugly no matter how you try to dress it up as “patriotism” or “investment.” Stop with the class warfare. Start looking for new alternatives to our current tax system instead of continuing to vilify those who have more money than yourself (or those whose money you’d like to spend for them).

A Fair Tax system, which would require everyone to pay the same percentage of their income (and end loopholes and deductions for everyone) would generate more revenue and would put an end to the pettiness of the class warfare crowd.

PICTURE I.D. FOR VOTING

A lot of commentators have been opining on the voter ID proposals taken up in the Legislature this year. Unfortunately, many of them (Star Tribune editors included) seem to have neglected to read the bills, or to understand how they work before sounding off.

Minnesotans may soon be asked whether to amend the state Constitution to require voters to present ID. It's important that the public be well-informed about the proposal. Hyperbole and misinformation do a disservice to the electorate.

There are three components to verifying a voter's eligibility: Identity, residence and eligibility. Voters should be expected to demonstrate that they are who they say they are, that they live where they say they live and that they are eligible.

There is no doubt that the party , Republican, with most to gain to be in favor and those with The least to gain ,Democrat, to reject.

ENHANCED INTERROGATION WORKS

Give the left an inch, and watch for a thousand miles of hyperbole, as in concluding mainly from three instances of waterboarding that the United States under George W. Bush became a sadistic, Nazi-style torture haven for no productive reason.

That last assumption -- that nothing came out of the exercise to justify it -- has once more been seriously challenged, this time by the revelation that tough interrogation techniques produced information crucial in arranging Osama bin Laden's exit last week from terrorism and other earthly activities.

PROTECTING DRUG MAKERS FROM LAWSUITS

Less than a week after issuing sweeping ruling that bars most lawsuits against medical device makers, the Supreme Court heard arguments in the first of two cases that could determine whether drug makers receive similar protection. The fundamental question in these cases is who should make the decisions that will determine whether a drug is "on balance, going to save people, or on balance, going to hurt people?" A jury of 12 is would be more likely to see before them only the people whom the drug hurt and don't see the many more who need the drug to cure them. Conservatives are much more likely than liberals to unnerstand this position. This would severely limit the billions of dollars taken by the trial lawyers in such lawsuits. Bills to limit lawsuits, or tort reform, are routinely voted no my Democrats and yes by Republicans due to the fact that the Trial Lawyers Assn. of America gives 97% of their political donations to the Democratic party. You don't bite the hand that feeds you.

Justice Stephen Breyer sez "congress left policing of the medicine market exclusively to the Food and Drug Administration." The FDA completely oversees the drug and device markets, and should no be second-guessed by courts

LIBERAL ACTIVISM

The subject of this letter is activism, something that is frequently carried out by riot and civil disobedience. The subject of the demonstration is typically based on a popular liberal political agenda and carried out by using inexperienced young people as pawns. These are young people who are looking for a cause and will embrace any cause thet excites them. They will get very passionate about a subject of which they have no understanding and have been informed only enough to meet the needs of their sponsors.

The object of these demonstrations is to force the majority of the people to accept their point of view, with a subsequent change of behavior , in order to meet the standards that they are promoting. I personally resent tjis type of intrusion and would rather communicate by writing letters to the editor and not using all the meaningless used by the anti-war abd anti-world trade activists. Most of their slogans have to do with the intense hate they have for corporations, some thing that they have learned from our politicians who like to buy votes by trashing corporations. One example "Hell no, we won't go. We won't fight for Texaco" I have never heard exactly what they mean by this, they just speak in a series of one-liners. I believe the best way to influence people is by presenting your ideas in a sane and intelligent manner without using force.

MEXICANS ON PAYNE AVENUE

To Myrna Ione Nelosn Pioneer Press letter Christmas Day. I have mixed feelings about the illegals, but deep down my feelings are mostly positive, even though I have a hard time admitting it. I go out of my way to have personal contacts with Mexican people and like to display my limited(Johnson High School)knowledge of the Spanish language. Some examples; Bueno dia senor (Good day sir), Usted esta muy bonita (You are very beautiful, this may get me in trouble) Yo hablar pequeno Espanol (I speak little Spanish).

Payne Avenue once dominated by Yohnson, Tenquist, Olofson and the Salvation Army band is now being revived by the many Latino people in the area and is showing positive growth. My former drug store location at Payne and Jenks is now Las Tapitas and my gradfather's location at Payne and Sims is now La Perla Tortelleria. With the recent addition of Phalen Boulevard and the presence of the Mexican Culture, Payne Avenue is on it's way back.

RE-ELECTED AFTER INDISCRETION

To follow a list of politicians charged with various indescretions:
Number one, William Jefferson (D LA) served nine terms starting in 1991 and terminated 2008 when jailed shortley after being re-elected. He was charged for receiving a $100,000 bribe of which $95,000 was found in his regrigerator freezer.

Number two, Kwame Kilpatrick mayor of Detroit elected first term in 2001 until sent to federal prison on ten felony counts. He was re-elected November 2005 while being investigated for charging $210,000 for personal expenses and awarding a no-bid contract for a campaign worker.

Number three, Tom DeLay (R Tx) assigned House Majority Leader during 2002 and was charged with money laundering on October 3, 2005. He represented the state of Texas as a Republican from 1984 to 2006 and was never re-nominated by the Republican party for election.

Number four, Charles Rangel (D NY)represented the state of New York as a Democrat from 1971 until ?. Early in the year 2008 congress ethics committee .started to investigate Rangel for intentionaly failing payment of income tax and 11 counts of accepting illegal gifts. The tax issue was a sore point for several members of the ethics committee, who said it was especially egregious that a former chairman of the House's tax-writing committee failed for 17 years to pay taxes on the income from his island villa. With all this over his head he was nominated by the Democrat party and elected with nearly total support of the citizens of Harlam in the mid-term election of 2008. Now with a total of 23 congressmen to be censured in the past he has joined them with censure. I wanna bet $1,000,000 that he will not be convicted of tax evasion as would others be.

Number five, Ted Kennedy (D MA) served the state of Massacheusits as a Democrat for 8 terms starting in 1962. The incident on the Island of Chappaquick on July 18 1969 (but for the grace of God go I) had no effect on his subsequent re-elections.

Number six, Senator Larry Craig (R NV) served the state of Nevada in the Senate until 2007. During June 2007 he was charged with disordely conduct in a restroom of the Mpls/StPaul International Airport wth no damage to another person. He was asked by his Republican collegues to resign his Senate post but refused. Due to his bad behavior he surely was not nominated to run for the next term nor would the citizens of Nevada have supported his re-election.

Number seven, Rep Maxine Waters (D CA) served the state of California as a Democrat starting in 1993. On August 3 2010 the congress ethics committee started investigation of violations of rules. Waters is charged with improperly trying to obtain federal bailout money for a bank in which her husband owns stock and formerly was a director. She has vigorously denied the charges. With this known by all voters in her district she was elected by a wide margin.

Number eight,Mayor Marion Berry ,a leader in civil rights, served two terms as mayor of Washington DC 1979 - 1991 and 1995 - 1999. The reason for the time not in office was due to serving time in Federal Prison for smoking cocaine and accepting bribes. Even with all his lawbreaking he was again elected to office.

The point to be made with these facts is that those elected after their indiscretions were all Democrats and no Republicans.

LABOR VS MANAGEMENT

It is totally reasonable to have conflict between labor and management. Each side puts it's own interests in first place to gain what they may need. It is normal to use offensive, rather than defensive measures, to accheive their goals. I believe that I am able to take a neutral point of view as I have represented both labor and management over my 54 year pharmacy career. This included the ownership of my own pharmacy on Payne Avenue and then employment by Snyder Drugs where I was very active in organizing with the United Food and Commercial Workers.

Question: Why does Governor Walker of Wisconsin not support labor unions? next question: Why do labor unions donate 93% of their political donations to Democrats? Third question: WHO OWNS WHO?

47% PAY NO INCOME TAX

As it is today, the top 1%  of income earners.  pay 38% of all federal  income tax and the  bottom 47% pay no income tax at all. Representation without taxation  is as threatening to our national character as is taxation without representation. Those who do not pay taxes  _ that is,  who are not pulling their weight in the community _ have no real reason not to vote for more and more government services. That will lead to more and more dependency  making this country more and more like a European  welfare state. This country was built on personal responsibility, work and  risk taking.

The right to own property is central to man’s existence. Private ownership of property (including land, businesses and goods) gives individuals security and a means to control their own affairs. Ownership brings responsibility and allows individuals to plan for the future so as to provide for themselves and their families. For example, owning a house, a business or some land makes it possible to borrow against that property so that individuals can invest for the future. The lack of private property rights in much of Africa makes such borrowing and investment impossible, and is one reason for the continent's lack of economic growth.  

The drive to succeed as an individual is the strongest motivating factor a human being can feel in their work. When work is uncoupled from reward, or when an artificial safety net provides a high standard of living for those who don’t work hard, society suffers. The fact that individuals are driven to succeed is in all our interests.

FAIRNESS DOCTRINE

Typical of Democrats: "if you don't like something just pass a law". The most recent example of this is the Fairness Doctrine now being supported by most Democrats to be passed as soon as possible. The primary purpose of the doctrine is to censure talk radio which is nearly exclusively controlled by conservative rhetoric. This would give the federal government more unecessary control over our thoughts and give liberals an unfair means to subdue conservative ideology. As seen on Nielsen ratings liberal talk radio is way far behind Sean Hannity, Dennis Prager, Hugh Huwitt, Rush Limbaugh, Michael Medved and Jason Lewis. This has resulted in a drastic drop in commercial sponsorship sorely needed to fund their programing and this resulted in the loss of Al Franken's failed Air America talk
show.

UNFAIR TO MANAGEMENT

My subject is the Employee Free Choice act designed to remove the right of workers to decide whether or not to organize a union using a secret ballot. Headline in Union Advocate newspaper sez “Al Franken will be proud to sponsor the Employee Free Choice Act when elected to the US senate. “

I can speak from personal experience. When trying to organize a union in 1974 while working for Snyder Bros. Drugs we had a large majority of employees sign authorization cards to be followed by an election with secret ballot and it was voted down by the workers. All but one in my store signed cards I believe as a favor to me but with time to think and talk about it they changed their minds.

On visiting Mr. Franken’s office on University Ave I was told that the secret ballot would still be an option. Not true. To quote wording in the bill, “ The board shall not direct an election but shall certify the individual or labor organization as the representative.” Under the EFCA the employer would no longer have the opportunity to demand a secret ballot election when a majority of employees sign the union card,.

The act would take away a workers fundamental right to a secret ballot while voting to approve a union. This could lead to intimidation by union leaders of employees that do not want to be unionized.

It is natural for democrats to give unions 100 percent support to repay them for the fact that unions give more that 90 percent of their donations to the Democratic party. This can be seen at www.fec.gov. You don’t bite the hand that feeds you. I report, U decide . By alanrph2@msn.com.
